Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Pawly mobile application (the “App”) operated by EDRVN Development (“we”, “us”, “our”, “Pawly”).

By downloading, installing or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. The App

Pawly is a personal tool application that allows you to:

• create an account using your email address
• upload, store and view your own photos and videos
• receive notifications from the App (if enabled)

The App does not contain social networking features, public feeds, messaging, comments, likes, sharing with other users, or any form of user-to-user interaction.

2. Eligibility

You must be at least 13 years old to use the App (or older if required by the laws of your country).
If you are under the age of majority in your jurisdiction, you represent that you have your parent’s or legal guardian’s permission to use the App.

3. Account

You are responsible for:

• maintaining the confidentiality of your account credentials
• all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently or abusively.

4. User Content

You retain ownership of any photos, videos or other content you upload to the App (“User Content”).

By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to:

• store, host, reproduce, display and distribute your User Content solely as necessary to provide and operate the App
• create technical derivatives (thumbnails, compressed versions, etc.) for performance reasons

You represent and warrant that your User Content does not infringe any third-party rights and does not contain unlawful material.

We may remove or disable access to any User Content at our sole discretion if we believe it violates these Terms or applicable law.

5. Prohibited Conduct

You agree not to:

• use the App for any illegal purpose
• upload content that is obscene, defamatory, violent, hateful, or infringes intellectual property rights
• attempt to reverse engineer, decompile, or extract source code from the App
• interfere with the App’s operation or security
• use automated means to access or collect data from the App without permission

6. Subscriptions and Payments

The App may offer certain features, content, or functionality on a subscription basis (“Subscriptions”).

Subscriptions are provided through in-app purchases processed by Apple App Store (for iOS) or Google Play (for Android).

By purchasing a Subscription, you agree to pay the stated price and any applicable taxes.

• Auto-Renewal. Subscriptions automatically renew at the end of each billing period (monthly, yearly, etc.) unless you cancel them. You will be charged through your App Store / Google Play account on the day the current period ends.
• Cancellation. You may cancel your Subscription at any time through your device settings:
  – On iOS: Settings → [your name] → Subscriptions
  – On Android: Google Play Store → Subscriptions
  Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods unless required by law.
• Free Trials. If a free trial is offered, it will automatically convert to a paid Subscription unless cancelled before the trial ends. You will be charged the full price on the first day after the trial.
• Price Changes. We may change Subscription prices. You will be notified in advance (via the App or store notification). Continued use after the change constitutes acceptance of the new price.
• Refunds. All payment and refund requests are handled by Apple or Google according to their policies. We do not provide refunds directly except where required by applicable law.

All Subscriptions are non-refundable, non-transferable, and may not be resold.

7. Termination

You may stop using the App at any time by deleting your account or uninstalling the application.
We may suspend or terminate your access immediately if you violate these Terms.

8. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EDRVN DEVELOPMENT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THESE TERMS OR THE USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM (OR $100 IF YOU PAID NOTHING).

10. Changes to the Terms

We may update these Terms from time to time. The updated version will be made available in the App. Your continued use of the App after such changes constitutes acceptance of the revised Terms.
